Subpoena Duces Tecum
I had filed a Motion to release the record I believed I had subpoenaed from Child Protective Services (C.P.S.) for October 19, 2000. At the hearing on September 14, 2000 the judge and the clerk stated that the no fax had been recieved. I had called C.P.S the week after to inquire if the fax had been transmitted and they stated that it was faxed the day following the hearing. Upon inquiry with the clerks office as to the whereabouts of evidence I was told that the evidence clerk would be in possesion of the document. Based on this the Motion to release was filed. At the October 19 hearing the judge and the clerk had no idea there was a record in evidence relating to my case. I phoned the evidence clerk and asked about the record and there was none. All things considered I subpoenaed again, this time with a proper subpoena served well in advance of the hearing date of November 16, 2000.

This time on the face page of the affidavit I named the party making the report. Appearing here as "medicine man".

I used the same affidavit as the first subpoena.
